National Legislation

South African Schools Act 84 of 1996 (SASA) The principal statute governing public schools in South Africa. Establishes the School Governing Body, sets out its composition, powers, and duties, and governs school fees, admissions, language policy, and financial management. Substantially amended by the Basic Education Laws Amendment Act 32 of 2024.

Basic Education Laws Amendment Act 32 of 2024 (BELA) Amends SASA and the Employment of Educators Act. Key changes affecting SGBs include updated requirements for the chairperson independence rule, revised admissions and language policy obligations, and strengthened accountability provisions. Signed into law on 13 September 2024; provisions take effect on a date proclaimed by the President.

National Education Policy Act 27 of 1996 (NEPA) Establishes the national policy framework within which all education legislation and governance must operate. Sets the basis for the Minister's authority to determine norms and standards that SGBs must comply with when setting admissions, language, and other school policies.

Protection of Personal Information Act 4 of 2013 (POPIA) South Africa's primary data protection legislation. Governs how SGBs collect, process, store, and share personal information — including learner records, parent contact details, and staff data. SGBs are responsible parties under POPIA and must ensure compliance with its conditions for lawful processing.


Provincial Legislation

Western Cape Provincial School Education Act 12 of 1997 The Western Cape's primary school education legislation, read alongside SASA. Establishes the Provincial Minister's obligation to create a governing body for every public school, and sets out provincial-specific requirements for SGB composition, elections, and governance. References in SGB 101 to provincial obligations apply specifically to schools in the Western Cape; other provinces have equivalent legislation.


A note on amendments

South African education legislation is actively amended. BELA 2024 represents the most significant revision to SASA since its enactment. Where SGB 101 references specific sections, it reflects the law as amended. Always verify the current version of any section against the official Government Gazette before relying on it for formal decisions.
